Although the vast majority of notaries in Kazakhstan believe that a foreign company (i.e. a foreign legal entity whose place of registration is not the Republic of Kazakhstan) cannot own a home in Kazakhstan, this is actually a misconception.
Indeed, the current legislation of Kazakhstan prohibits foreigners temporarily staying in the territory of the Republic of Kazakhstan from owning a home (by virtue of Article 9 of the Law of the Republic of Kazakhstan “On the Legal Status of Foreigners”).
However, this prohibition applies only to foreigners – individuals.
As for foreign companies, according to Article 9 of the Law of the Republic of Kazakhstan “On Housing Relations”, foreign legal entities enjoy rights in the Republic of Kazakhstan and bear obligations in housing relations equally with legal entities of the Republic of Kazakhstan, unless otherwise established by legislative acts of the Republic of Kazakhstan.
For foreign legal entities, no exceptions to this rule are provided for by other legislative acts of the Republic of Kazakhstan.
Thus, foreign legal entities have the right to own housing and other real estate in Kazakhstan (houses, buildings, structures, production and non-production complexes, etc.) without restrictions.
Along with this, foreign legal entities (non-governmental), as well as foreign citizens, may have land plots in private ownership for the following purposes: for development, built-up production and non-production, including residential, buildings (structures, facilities) and their complexes, including lands intended for servicing buildings (structures, facilities) in accordance with their purpose (clause 3 and 4 of Article 23 of the Land Code of the Republic of Kazakhstan).
An exception is made for land plots intended for commercial agricultural production, afforestation, as well as land plots located in the border zone and border strip of the Republic of Kazakhstan (clause 4 of Article 23 of the Land Code of the Republic of Kazakhstan).
Thus, foreign non-state legal entities (foreign private companies) can own any housing, building, structure, house, production and non-production facilities, etc., as well as land plots servicing these real estate objects.
